Commissioner Peter Sorenson presided with Commissioners Bobby Green, Sr., Tom Lininger and Anna Morrison present. Bill Dwyer was excused. County Administrator Bill Van Vactor, Assistant County Counsel Stephen Vorhes and Recording Secretary Melissa Zimmer were also present.
1. ORDER 03-5-21-7/In
the Matter of Closing Out the Metropolitan Wastewater Service District
Wastewater Bond Retirement Fund and Transferring the Remaining Fund Balance in
the District's Wastewater Administration and Construction Fund.
Dave Garnick, Senior
Budget Analyst, reported that the Metropolitan Wastewater Service District was
formed in 1978 to sell general obligation bonds to finance the local share of
the design and construction of the regional sewage facilities. He noted the G.O. bonds were fully paid in
August 2002 and earlier this year the Board transferred ownership of the
regional facility to the Metro Wastewater Management Commission. He said since the purpose of the wastewater
bond retirement fund has been fulfilled and is no longer needed, the purpose of
the fund has been fulfilled and is no longer needed. He explained according to ORS 294.475, when a fund of a municipal
corporation ceases to exist and a balance remains in the fund, the governing
body shall declare by ordinance or other order that such balance shall be
transferred to the general fund of the municipal corporation as other
provisions had been in the original creation of the fund. He added since the original creation of the
fund did not specify any other provisions for those funds at that time, the
purpose of the order is to close the retirement fund with the balance of
$149,000. He recommended closing the
bond retirement fund and the remaining balance to be rolled into the
administration and construction fund.
MOTION: to approve ORDER 03-5-21-7.
Morrison MOVED,
Green SECONDED.
VOTE: 4-0.
2. PUBLIC HEARING
AND ORDER 03-5-21-8/In the Matter of Adopting the FY2002-2003
Metropolitan Wastewater Service District Supplemental Budget #1, Making,
Reducing and Transferring Appropriations.
Garnick noted under
local budget law, supplementals are required to appropriate unanticipated
revenues and expenses that were not foreseen at the time the original budget
was prepared. He added it is also required where transfers create a new
appropriation category or where there are adoptions of appropriations. He said
the budget authority that is in the wastewater bond retirement fund needs to be
removed and to increase the budget authority in the admin and construction
fund. He noted it was over a 10% change
in the budget and a public hearing was required.
Sorenson opened up
the Public Hearing. There being no one
signed up to speak, he closed the Public Hearing.
MOTION: to
approve ORDER 03-5-21-8.
Morrison MOVED,
Green SECONDED.
VOTE: 4-0.
There being no further business, Commissioner Sorenson adjourned the meeting at 12:10 p.m.
