Commissioner Faye Stewart presided with Commissioners Bill Dwyer, Bill Fleenor, Bobby Green, Sr., and Peter Sorenson present.  County Administrator Bill Van Vactor, Assistant County Counsel Stephen Vorhes and Recording Secretary Melissa Zimmer were also present.

  16. PUBLIC HEARINGS

A. ADJUSTMENTS TO THE AGENDA

None.

B. PUBLIC HEARINGS/MEASURE 37 CLAIMS

1) ORDER 07-6-27-16/In the Matter of Considering a Ballot Measure 37 Claim and Deciding Whether to Modify, Remove or Not Apply Restrictive Land Use Regulations in Lieu of Providing Just Compensation (PA06-7347, Nielsen2).

Matt Laird, Land Management, explained that the property is currently zoned E-40 Exclusive Farm Use.  He indicated that information has been submitted showing that property was originally acquired on October 14, 1966 when the property was unzoned.  He recalled that this claim was originally heard on May 8, 2007 and at that point Lane Management Division showed this as an incomplete claim because it was missing valuation information.  He said that Mr. Nielsen attended the hearing and asked for additional time.  He said since that time, he has submitted the comparative market analysis that shows there was a value reduction.  He said they show this as a valid claim and recommended approval.

Commissioner Stewart opened the Public Hearing. 

George Nielson, Junction City, said he is the applicant.  He didn’t have anything to add.  He wanted to make sure all the information was in place.  He was happy approval was recommended.

There being no one else signed up to speak, Commissioner Stewart closed the Public Hearing.

Stewart asked if there were any ex parte contacts.

There were none.

MOTION:  to approve ORDER 07-6-27-16.

Fleenor MOVED, Dwyer SECONDED.

VOTE: 5-0.

17. OTHER BUSINESS

None.

There being no further business, Commissioner Stewart adjourned the meeting at 3:40 p.m.
